1. Eligibility
To attend an Urban Social event and use this web
site you must you must verify that you have read these Terms and
Conditions. This sets out the legally binding terms for you (the
“participant”) for use of the Urban Social web site
and involvement in any Urban Social events.
2. Participation
The participant must be at least nineteen years
old to register for or attend Urban Social events. You represent
and warrant that you have the right, authority, and capacity to
fulfil, and will fulfil, all the Terms and Conditions.
3. Match
Urban Social has one type of "match"
at Lock and Key parties. This occurs when two participants have
unlocked a padlock with their lock and key. Another “match”
occurs, at the Board Games Party when you, the participant is chosen
by another participant to exchange e-mail information via Urban
Social. Urban Social are not responsible if a participant does not
receive any matches during the course of an event.
4. Liability
You agree to release Urban Social and affiliated
partners from any liability and assume the full responsibility and
risk with people you meet during or after a Urban Social event.
Urban Social assumes no responsibility for any injury, loss, theft,
bodily injury and or emotional distress and discomfort, physical
damages, economic loss, damages (direct or indirect), incidental
and/or consequential, arising out of the use of this service, including,
without limitation, to damages arising out of communicating and/or
meeting with other members of this event, or introduced to you via
this event. You release Urban Social and their affiliated partners
from any claims, liabilities and suits in connection with any Urban
Social event.
Urban Social does not screen the participants for
services offered by Urban Social in any way. Urban Social requests
all prospective participants if they are single. But Urban Social
does not verify this information. Therefore, Urban Social is not
liable for the integrity of statements made by participants as to
their marital status and general background. It is incumbent and
advised upon the user to verify any and all information relating
to but not limited to this subject. It is advised to check references
of any participant. Urban Social is not responsible for information
given out from one participant to another participant with use to
the “Flirt” cards. Urban Social advises to use caution
and common sense when giving out personal information to another
participant.
A participant agrees to release Urban Social from
any claims arising from actions taken by party organizers, assistants,
affiliates, partners or the venue in which the Lock and Key/Board
Games party takes place. Thus, you agree to waive any and all liability
against Urban Social, the Venue that the party is held, any sponsors
associated with the Party or our Company, and/or all staff members
associated with Urban Social and the Venue.
5. Release
At certain times Urban Social may take photographs
at events for use as promotional printed and online material. You
agree to release your photo/image without compensation of any kind.
6. Copyright
All materials included on this web site are protected
by copyright, trademark and other laws. You may not copy modify,
reproduce, transmit in any form or by any means, electronic, mechanical,
photocopying, recording, scanning, or otherwise, except with the
prior written permission of Urban Social.
7. Payment
By providing Urban Social with your personal details
and payment information, you allow us to charge your credit card
number/debit your personal PayPal account for the specific amount
authorised by you, the participant.
8. Privacy
You have read and understood our Privacy
Policy.
9. Revisions
Urban Social may at any time revise these Terms
and Conditions by updating this posting. You are bound by any such
revisions and should therefore periodically visit this page to review
the then current terms and conditions to which you are bound. By
continuing to access urbansocial.ca after modifications to these
Terms and Conditions are posted, you are agreeing to accept the
Terms and Conditions as modified.
10. Warranty
THE INFORMATION ON THIS WEB SITE IS PROVIDED "AS
IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED,
INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR TITLE. URBAN
SOCIAL AND ITS AFFILIATED PARTNERS ARE NOT RESPONSIBLE FOR INACCURACIES
OR TYPOGRAPHICAL ERRORS.
URBAN SOCIAL AND AFFILIATED PARTNERS ASSUME NO
LIABILITY FOR ANY DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION,
INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR INCIDENTAL DAMAGES
OF ANY KIND, LOST PROFITS, REVENUE, USE, BUSINESS INTERRUPTIONS,
LOSS OF PROGRAMS OR OTHER DATA ON YOUR INFORMATION HANDLING SYSTEM
OR OTHERWISE, WHETHER BROUGHT IN CONTRACT OR TORT, ARISING OUT OF
OR CONNECTED WITH THIS WEB SITE, THE INABILITY TO USE THIS WEB SITE
OR THE USE, RELIANCE UPON OR PERFORMANCE OF ANY MATERIAL CONTAINED
IN OR ACCESSED FROM THIS WEB SITE OR ANY LINKED WEB SITE, EVEN IF

11. Jurisdiction
This Agreement between you and Urban Social shall
be governed by, and interpreted in accordance with, the laws of
the Province of Ontario and Canada applicable therein. You hereby
consent and submit to the non-exclusive jurisdiction of the courts
of Ontario in any proceeding related to this agreement.
